1.1 By creating an account, browsing listings, making a Booking, or listing an Item, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy (Part II), incorporated here by reference. If you do not agree, do not use the Platform.

1.2 You must actively accept these Terms, by checking a clearly-labelled box or tapping “I Agree”, before completing registration. Continued use of the app after a change to these Terms (§20) constitutes acceptance of the updated version.

1.3 These Terms apply to every User of the Platform, whether acting as a Renter, a Host, or both.

3.1 You must be at least 18 years old and able to form a binding contract in your country of residence to use the Platform. Anywear does not knowingly permit anyone under 18 to hold an account (see also our Privacy Policy, Part II §9).

3.2 All Users must provide a verified email address and phone number at registration. Browsing is open to everyone, but identity verification is required to transact. A Renter verifies their identity through Stripe Identity (a photo of a government-issued ID and a selfie) when sending their first Booking or Buy-Out request, and pays the one-time Trust & Safety Fee with their first Booking (§7.1). A Host is verified free of charge as part of Stripe Connect payout onboarding, which must be complete before the Host can accept a Booking (§6.3). Verification is normally completed once, but Anywear may ask a User to verify again where an account is flagged — for example, after a change of phone number, or where a card or device appears suspicious.

3.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at the contact in §21 if you suspect unauthorized access.

3.4 One account per person. Operating multiple accounts to circumvent Platform rules, promotions, or a suspension is a violation of these Terms.

3.5 You may act as both a Host and a Renter on the same account — the two roles aren't mutually exclusive, and there's no separate registration for each.

3.6 Some Items carry additional booking requirements based on their value (“trust tiers”). An Item worth up to $500 can be booked by any Renter with a verified ID; an Item worth more than $500 and up to $1,000 requires a verified ID and at least one review on the Renter's account; and an Item worth more than $1,000 requires a verified ID and at least three five-star reviews.

4.1 Anywear is a marketplace platform that connects Renters and Hosts. Anywear is not a party to the rental agreement or sale formed between a Renter and a Host, does not own, store, ship, inspect, or take possession of any Item, and is not a rental company, a clothing retailer, or an insurer.

4.2 Each Booking and each Buy-Out is a direct contractual arrangement between the Renter and the Host. Anywear facilitates discovery, payment, and dispute resolution as described in these Terms, and acts as an evidence-based arbiter of last resort under §10 — it does not guarantee the condition, authenticity, availability, or fitness for purpose of any Item.

4.3 Nothing in this section limits Anywear's own obligations under these Terms (including the fee, refund, and liability-cap provisions below) or under applicable consumer protection law, which may impose responsibilities on marketplace operators that these Terms cannot exclude.

4.4 The Platform currently operates in 13 cities in Europe and North America: London, Paris, Barcelona, Madrid, Rome, Milan, Lisbon, Amsterdam, and Athens in Europe, and New York, Miami, Los Angeles, and Vancouver in North America. Anywear may add cities, or change where the Platform operates, from time to time. Hosting is available only where Stripe Connect payouts are supported (§7.3).

5.1 To request a Booking, a Renter provides travel dates, party size, style and size preferences, and selects one or more Single Items, or a Bundle, from one Host. Availability is shown for the requested dates and destination city.

5.2 When a Renter sends a Booking request, Stripe places a temporary hold on the Renter's card for the all-in price shown at checkout; the card is not charged at this stage. A Booking request is not confirmed until the Host accepts it (§6.3), at which point the Renter's card is charged. Anywear may decline to process a Booking or Buy-Out at its discretion, including where fraud, abuse, or a Platform violation is suspected.

5.3 By default, pickup and return take place by in-person handover in a public place or a hotel lobby, arranged directly with the Host through in-app messaging; the exact meeting spot is shared once the Booking is confirmed. A Host may also offer their own delivery options on a listing — such as courier, post, or hotel drop-off — each at a price the Host sets, which the Renter pays at checkout as part of the all-in price if they choose that option. Anywear does not itself provide or arrange any courier or postal service. A Host may also offer a lockbox, subject to §5.8. Items are returned in person unless the Host agrees in the in-app chat to a different return method; where an Item is returned by post, the Renter must share the tracking number in the chat. If the other party doesn't attend an agreed handover, report it in the app straight away (Get help on the Booking) so that Anywear Trust & Safety can review it. Anywear is not responsible for a Renter's or Host's failure to attend an agreed handover, though repeated no-shows may result in account review under §18.

5.4 At handover, the Host gives the Renter a 4-digit Hand-off Code. The Renter taps “Mark as Delivered” in the app and enters that code, which confirms receipt and starts the rental period. On receiving an Item, the Renter must take time-stamped photos of it in the app and report any pre-existing damage, missing piece, or discrepancy from the listing the same day they receive it (§10.5). Absent a same-day report, the Item is deemed received in the condition shown in the Host's handover photos (§6.4).

5.5 A Renter may also purchase an Item outright rather than renting it — see Buy-Out, §6.5 and §7.5. A Buy-Out is a sale, not a Booking, and follows the terms in those sections rather than the rental mechanics in this one.

5.6 Renters can expect Hosts to meet a few ground rules, most already covered elsewhere in these Terms: accurate listings (§6.2), honouring accepted Bookings (§6.3, §9.4), responding to messages in reasonable time (generally within 24 hours before pickup, and as promptly as possible on the pickup day itself), and handing over Items that are clean and in the condition shown (§6.2, §10.2). A Host who repeatedly falls short of these is subject to the same enforcement and review consequences as any other policy violation (§12, §18).

5.7 Anywear does not offer refunds because an Item doesn't fit or suit the Renter, where the Item matches the size and description shown on its listing. AI size matching and other fit guidance in the app are guidance only; Renters are encouraged to confirm fit with the Host before booking. An Item that is a different size from, or materially not as described in, its listing is handled under §5.4 and §10.4.

5.8 A lockbox is an optional handover method that a Host may choose to offer and must provide themselves; where one is used, the Host shares the access code through the in-app chat after the Booking is confirmed. Anywear does not provide, own, inspect, or control any lockbox, makes no representation about a lockbox's location, condition, or security, and, to the extent permitted by law, is not responsible for any loss, theft, damage, or access issue arising from the use of a lockbox. A Renter uses a Host's lockbox at their own discretion. The Host remains responsible for the Item until the Renter collects it, and the Renter is responsible for it from collection, under §10 and §11. The photo and reporting requirements in §6.4 and §10.5 apply to a lockbox handover in the same way as to any other handover.

5.9 The rental period starts when the Renter taps “Mark as Delivered” (§5.4) and ends when the Host taps “Mark as Returned” on getting the Items back (§10.5). A Renter who wants to keep an Item longer must request an extension in the app before the Booking's end date (§6.1). Returning an Item early does not entitle the Renter to a refund for unused days.

6.1 Hosts set their own daily price and availability calendar for each listing, and the app shows a suggested price band based on comparable listings. Every Booking runs for a minimum of 3 days and a maximum of 30 days; a Host may set a longer minimum on a listing, and may choose to accept a Renter's request for a shorter rental of 1–2 days (a Bundle rented for 1–2 days still costs its base price, §2). Extensions must be requested in the app before the Booking's end date and approved by the Host; extra days are charged at the listing's daily price (or $25 per day for a Bundle), together with the fees in §7.1, subject to the 30-day maximum.

6.2 Each listing must include: at least 8 photos taken from multiple angles, the Item's category and brand, accurate size and condition information, an honest description, a daily price, an availability calendar, the handover and any delivery options offered, and a Declared Replacement Value (§2, §10). Hosts may offer Items from their own wardrobe together as a Bundle, priced as set out in §2; all Items in a Bundle must come from the same Host. Every Item must have a retail value of at least US$50. Each new listing is reviewed by Anywear before it goes live, usually within 24–48 hours, and may be declined if it doesn't meet these Terms.

6.3 On receiving a Booking request, a Host has 48 hours to accept or decline. Declining requires no explanation and carries no fee or penalty for either side. A request that receives no response within 48 hours expires, the hold on the Renter's card is released, and the Renter is not charged. On acceptance, the Renter's card is charged and the Item's calendar locks for the Booking dates. A Host may publish listings before completing Stripe Connect payout onboarding, but cannot accept a Booking until that onboarding is complete (§7.3).

6.4 Before handover, a Host must take time-stamped photos of every Item in the Booking in the app — the Platform will not allow an Item to be marked as handed over without these photos uploaded (the “Evidence Locker”, §10.5).

6.5 A Host may enable any listing for Buy-Out, allowing a Renter to purchase the Item outright at a price the Host sets. Even where Buy-Out is not enabled on a listing, a Host may separately agree to a Renter's individual request to buy an Item. Once a Buy-Out is confirmed and paid for, ownership of that Item transfers to the Renter, and the rental-specific terms in §9 (Cancellations), §10 (Damage, Loss & Liability), and §11 (Late Returns) no longer apply to it — it is a completed sale, not a Booking. §6.6 below governs recourse if the Item isn't as described.

6.6 If an Item purchased via Buy-Out is materially not as described in the listing, the Renter may report this in the app the same day they receive the Item, for evidence-based resolution (§10.4). Outside that window, or absent a material discrepancy from the listing, the sale is final.

6.7 A Host warrants that they own, or have the legal right to rent or sell, every Item they list.

6.8 Booking- and Buy-Out-related communication should stay within the Platform's in-app chat. It's the record Anywear's evidence-based dispute process (§10.4) actually reviews, and it protects both sides if something is disputed later. Until a Booking is confirmed, the chat automatically hides phone numbers, email addresses, street addresses, social media handles, and links to outside sites.

6.9 A Host may remove or pause a listing at any time before a Booking or Buy-Out request is made against it. Once a request is pending, withdrawing the listing is treated the same as declining that request (§6.3) — no fee, no explanation required, and any already-confirmed Booking or Buy-Out is unaffected.

6.10 A Host may set specific care instructions for an Item, such as hand-washing only, no smoking near the Item, or return it in the packaging provided, similar to how a host sets house rules. Care instructions must be shown on the listing before booking; a Renter who follows stated care instructions is not liable for damage that instruction was meant to prevent if the Host's instructions turn out to have been wrong or misleading.

6.11 Anywear awards a “Star Lender” badge to Hosts who consistently meet its quality standards, including high ratings, fast replies, few cancellations, and accurate listings; Host-side cancellations count against it (§9.4). Search ranking takes into account factors including price drops, Star Lender status, the size of a Host's wardrobe (Hosts with 25 or more Items may also be eligible to be featured by Anywear staff), how active a Host is, and reviews. No User can pay to rank higher, and Anywear does not sell paid placement or listing boosts.

7.1 A Renter pays the rental price plus: a Service Fee of 5% of the rental price, with a minimum of $3 per Booking; any delivery fee the Host has set for a delivery option the Renter chooses (§5.3); VAT, GST, or similar tax on the Service Fee where due; and, on the Renter's first Booking only, the one-time $1.50 Trust & Safety Fee. These are shown together as one all-in price before the Renter sends a request. There is no deposit and no surcharge for the card used. A Host pays a Platform Fee of 20% of the rental price, with a minimum of $5 per transaction but never more than the rental price, plus VAT, GST, or similar tax on it where due, deducted from the Host's earnings. There is no listing fee. Anywear pays card-processing and Stripe Connect fees out of its own fees; the only payment-processing cost a Host bears is the payout fee for a Wallet withdrawal (§7.3). Cleaning between rentals is the Host's responsibility (§10); a Host may build the cost of cleaning into their listing price but may not charge it separately.

7.2 Examples, where no VAT or GST is due: on a $32 Single Item rental, the Renter pays $35.00 (the $3 minimum Service Fee applies), Anywear retains a $6.40 Platform Fee, and the Host receives $25.60. On a $105 Mini Bundle, the Renter pays $110.25 and the Host receives $84.00. On a $315 Full Bundle, the Renter pays $330.75 and the Host receives $252.00. Where 20% would fall under $5 (e.g. an $18 Item), the $5 minimum applies instead: the Renter pays $21.00, Anywear retains $5.00, and the Host receives $13.00. A Renter's first Booking also includes the one-time $1.50 Trust & Safety Fee. Where VAT is due, it is added to the Service Fee and to the Platform Fee — at a 21% rate, for example, the $32 Single Item rental costs the Renter $35.63 and the Host receives $24.26.

7.3 Payment for a Booking is held in Anywear's Stripe balance until the Renter confirms in the app that the rental is complete or, if no problem has been reported, until 48 hours after the Host taps “Mark as Returned” (§10.5), whichever is earlier. A report made under §10.5 freezes the payment until Anywear Trust & Safety decides. Once released, the Host's earnings, less the Platform Fee, are credited to the Host's Wallet. Wallet funds can be spent on the Host's own rentals on the Platform or, once the Wallet balance reaches $50, withdrawn to the Host's bank account through Stripe Connect. The Host pays Stripe's payout fee for each withdrawal, which is shown before the Host confirms it, and the money then arrives on Stripe's normal timetable. Hosts are paid only through Stripe Connect, so hosting is available only where Stripe Connect payouts are supported; Hosts elsewhere can join a waitlist. A Host must complete Stripe Connect payout onboarding before accepting a Booking (§6.3).

7.4 There is no security deposit. Instead, charges for damage, loss, or late return are decided under §10 and §11, capped at the Item's Declared Replacement Value, and collected from the Renter's saved card or backup card as described in §10.7.

7.5 The same fees apply to a Buy-Out, calculated on the sale price, consistent with §7.1: the Renter pays the Service Fee (5%, minimum $3) and the Host pays the Platform Fee (20%, minimum $5), and the Host's proceeds are credited to their Wallet in the same way as rental earnings (§7.3). Example: on a $90 Buy-Out, the Renter pays $94.50, Anywear retains an $18.00 Platform Fee, and the Host receives $72.00.

7.6 All payment transactions on the Platform, including currency exchange for cross-border Bookings, run through Stripe. Prices are displayed and charged in the currency shown in the app for your account; where a Renter and Host are in different countries, Stripe's own conversion applies to the payout, and Anywear does not add a separate currency-conversion fee on top. Payments are made by card only; cash is not accepted. Arranging or accepting payment outside the Platform is prohibited, may lead to restriction or suspension of the account (§18), and is not covered by the protections in these Terms.

7.7 Each User is responsible for declaring and meeting their own tax obligations arising from Platform activity, including any income tax on rental or sale proceeds. Anywear may be required to report transaction data to tax authorities in some jurisdictions and will do so where legally obligated, consistent with Part II §3.

7.8 Anywear Credit — for example, a refund paid as credit under §9.2, or credit earned under the referral programme in §8.5 — is separate from a Host's Wallet. Anywear Credit is applied automatically at checkout, has no cash value, cannot be withdrawn, exchanged for cash, or transferred, and must be used within any period stated when it is issued. Refunds paid as Anywear Credit are available immediately.

8.1 Anywear does not offer a paid subscription or paid plan. The AI packing assistant builds a packing list from the trip details a User provides — such as destination, travel dates, trip length, number of adults, the style of trip, style preferences, and sizes — and recommends real, bookable listings from local Hosts. Recommendations, including AI size matching, are guidance only (§5.7).

8.2 Each packing list uses one Packing Token and includes up to 3 refinements at no further cost. Every User receives 1 Packing Token at sign-up. A Renter receives 5 Packing Tokens for each completed Booking that meets a minimum rental value (currently $10), credited once per Booking, 48 hours after the rental is completed. No Packing Tokens are given for a Booking that is refunded or disputed, or that is made between accounts controlled by the same person or is otherwise self-dealt.

8.3 Packing Tokens have no cash value, cannot be bought, sold, or transferred, and do not expire. Anywear may adjust or revoke Packing Tokens obtained in error or through fraud or other abuse of the Platform.

8.4 Anywear may offer promotional codes or first-rental discounts from time to time, on the terms shown with each offer. Promotions are funded by Anywear and do not reduce the amount the Host receives for the Booking.

8.5 Under Anywear's referral programme, when a new User who joined through an existing User's referral makes their first Booking of $20 or more, the referring User and the new User each receive $10 of Anywear Credit (§7.8). Anywear may change, suspend, or end the referral programme at any time, without affecting Anywear Credit already earned, and may withhold or revoke referral credit where it reasonably suspects abuse, including self-referral or the use of multiple accounts (§3.4).

9.1 A Renter may cancel free of charge at any time before a Host accepts the Booking request; the hold on the Renter's card is released straight away.

9.2 Once a Host accepts, refund eligibility depends on how much notice you give before the Booking start date. The amounts below are shares of the rental price; the Service Fee and the Trust & Safety Fee (§7.1) are not refunded when a Renter cancels:

• 10 or more days before the start date full refund of the rental price
• Between 10 days and 72 hours before the start date a 30% cancellation charge applies; the remaining 70% is refunded
• Less than 72 hours before the start date the Renter may send a cancellation request, with a reason, through the app, and the Host decides. If the Host approves, 50% of the rental price is returned as Anywear Credit, which must be used within 30 days, and the remaining 50% is retained as a cancellation charge. If the Host declines, the Booking goes ahead and no refund is due

9.3 Once an Item has been handed over (§5.4), the Booking can no longer be cancelled by either party; any issue after that point is handled under §10 and §11.

9.4 If a Host declines or fails to respond before accepting, the Renter is not charged. If a Host cancels after accepting, the Renter receives a full refund, including the Service Fee, any Trust & Safety Fee, and any delivery fee, regardless of the timing in §9.2. Host-side cancellations count against the Host's search ranking and Star Lender status (§6.11), and repeated Host-side cancellations may also result in a temporary listing suspension.

9.5 A confirmed Buy-Out cannot be cancelled by the Renter once payment is authorised — it is a sale, not a Booking, and the cancellation rules above don't apply to it. Before the Host accepts a Buy-Out request, either party may withdraw freely, consistent with §9.1.

9.6 Where a Renter cancels and a cancellation charge applies under §9.2, the Host receives the amount retained (the 30% charge, or the 50% retained where the Host approves a cancellation within 72 hours), less the Platform Fee in §7.1. Anywear Credit issued under §9.2 is subject to §7.8.

10.1 A Renter's maximum liability for damage to, or loss of, an Item is capped at that Item's Declared Replacement Value, shown on the listing before Booking. Anywear is not a party to the rental and does not insure either side against loss — this cap allocates risk between Renter and Host, it is not an Anywear guarantee or insurance product.

10.2 Normal wear (light creasing, minor lint) is not charged.

10.3 Beyond normal wear, charges to the Renter are assessed as follows:

• Minor damage including stains that need specialist cleaning: the Host arranges the repair or cleaning and uploads the receipt in the app, and the Renter pays that cost. The Host keeps the Item and their earnings for the Booking.
• Beyond repair, lost, stolen, or not returned the Item's current resale value, capped at its Declared Replacement Value.
• Late return the extra-day charges in §11, capped at the Item's Declared Replacement Value.

10.4 Disputes — including a Buy-Out reported under §6.6 — start with a report in the app (Get help on the Booking). The Renter and Host can first try to resolve the issue between themselves in the in-app chat. If they cannot agree, Anywear Trust & Safety acts as the arbiter, deciding based on the Evidence Locker photos, the in-app chat, any receipts, and any other evidence provided, and executing the resulting payment adjustment through Stripe. Payment for the Booking stays frozen until Trust & Safety decides (§7.3). The process and timelines are set out in Part III §3.

10.5 Evidence and reporting deadlines are set out below. All photos are time-stamped and taken in the app, and the Platform compares return photos with the handover photos and flags differences automatically. A report made under this clause freezes payment for the Booking until Anywear Trust & Safety decides. Anywear may decline to consider a report made after these deadlines.

• Before handover (Host) photos of every Item, which the Platform requires before an Item can be handed over (§6.4).
• On receipt (Renter) photos of every Item on receipt; any pre-existing damage, missing piece, or mismatch with the listing must be reported the same day the Renter receives the Item. After that day, the Item's condition is treated as accepted.
• On return (Host) the Host taps “Mark as Returned”, photographs the returned Items, and must report any damage, missing piece, or other problem the same day the Items come back.

10.6 Where only some Items in a Bundle are damaged, lost, or not returned, §10.1–§10.3 apply separately to each affected Item, based on that Item's own Declared Replacement Value — not the whole Bundle's price — unless the listing states the Bundle is only available as a single inseparable Item.

10.7 Charges under this section and §11 are made only after a decision by Anywear Trust & Safety. They are taken from the Renter's saved card or, if that payment fails, from a backup card the Renter has added, with no additional Anywear fee, and are paid to the Host in full, with no Platform Fee deducted. Renters must keep a valid card saved to their account.

10.8 If a charge decided under this section or §11 cannot be collected from either card, Anywear will send in-app warnings and email alerts and freeze the Renter's account, so that no new Bookings or listings can be made. If the charge remains unpaid, Anywear will send a final notice giving 7 days to pay, after which the account will be suspended (§18) and the debt may be passed to a collections agency.

11.1 Items must be returned by the end of the Booking. A Renter who needs more time must request an extension in the app before the Booking's end date (§6.1).

11.2 If an Item is returned late without an approved extension, the Renter is charged the listing's daily rental price for each extra day — or, for a Bundle, the $25 extra-day rate — capped at the Declared Replacement Value of the Item or Items concerned. Late-return charges are made after a Trust & Safety decision and collected under §10.7–§10.8.

11.3 Where Anywear Trust & Safety decides that an Item has not been, and will not be, returned, it is treated as not returned under §10.3 and charged at its current resale value, capped at its Declared Replacement Value.

12.1 After a completed Booking, both parties may leave a rating (1–5 stars) and written review — Hosts are rated on accuracy, cleanliness, communication, and handover; Renters on care, punctuality, and communication.

12.2 Reviews containing hate speech, personal information, or retaliatory content are removed on report. A pattern of low ratings triggers account review and may lead to suspension under §18.

12.3 Reviews also count towards the trust tiers in §3.6: a Renter needs at least one review to book an Item worth more than $500, and three five-star reviews to book an Item worth more than $1,000. Otherwise, trust is handled through the identity verification in §3.2 and the Declared Replacement Value cap in §10.

14.1 The Platform, including its design, logos, and Anywear-created content, is owned by Anywear and protected by intellectual property law. Nothing in these Terms grants you rights to Anywear's brand or platform beyond what's needed to use the service as intended.

14.2 You retain ownership of photos and descriptions you upload for a listing, and grant Anywear a non-exclusive, royalty-free licence to display, reproduce, and promote that content on the Platform and in Anywear marketing.

14.3 You may not copy, scrape, or republish content from the Platform outside what's needed for your own personal use of the service.

15.1 THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” ANYWEAR DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ITEM WILL MATCH ITS LISTING IN EVERY RESPECT.

15.2 ANYWEAR IS NOT RESPONSIBLE FOR THE CONDUCT OF ANY USER, ON OR OFF THE PLATFORM, INCLUDING A HOST'S OR RENTER'S FAILURE TO HONOUR A BOOKING OR BUY-OUT, ATTEND A HANDOVER, OR RETURN AN ITEM AS AGREED, BEYOND THE PROCESSES SET OUT IN §9–§11.

16.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANYWEAR'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE PLATFORM FEES YOU PAID TO ANYWEAR IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) US$100.

16.2 ANYWEAR IS NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, ARISING FROM YOUR USE OF THE PLATFORM.

16.3 Nothing in this section excludes liability that cannot be excluded under applicable law, including liability for death, personal injury caused by negligence, or fraud.

18.1 You may close your account at any time through account settings. Open Bookings must be completed or cancelled first.

18.2 Anywear may suspend or terminate an account for violation of these Terms, repeated policy violations, fraud, or a safety concern, with or without notice depending on severity.

18.3 Sections that by their nature should survive termination — including §10 (Damage, Loss & Liability) for any open Booking, §14 (Intellectual Property), §16 (Limitation of Liability), and §17 (Indemnification) — continue to apply after your account closes.

18.4 If your account is suspended or terminated for a policy violation, you may request an internal review — see Part V §7 (Enforcement Appeals).

19.1 These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles.

19.2 Any dispute arising from these Terms that cannot be resolved through Anywear's support process (§10.4) will be resolved in the courts of England and Wales, without prejudice to a consumer's right to bring proceedings in their own country of residence where applicable law gives them that right.

19.3 Nothing in this section limits a consumer's non-waivable statutory rights in their country of residence, including rights under EU or UK consumer protection law where applicable.

21.1 If any provision of these Terms is found unenforceable, the remaining provisions continue in full force.

21.2 These Terms, together with the Privacy Policy (Part II), the Refund & Dispute Policy (Part III), the Cookie Policy (Part IV), the Safety & Trust Policy (Part V), and the Community Guidelines (Part VI), are the entire agreement between you and Anywear regarding the Platform.

21.3 Notices to Anywear should be sent to support@anywearglobal.app. We may notify you via the email or in-app notifications associated with your account.

21.4 Neither Anywear nor a User is liable for a delay or failure to perform caused by something beyond their reasonable control — natural disaster, war, government action, or similar. If this makes a specific Booking or Buy-Out impossible to complete, either side may cancel it for a full refund, outside the normal cancellation rules in §9.

21.5 Anywear may assign or transfer these Terms in connection with a merger, acquisition, or sale of substantially all its assets. You may not assign your own rights under these Terms without our consent.

21.6 You confirm that you are not located in, or a resident of, a country or region subject to comprehensive trade sanctions, and are not on any applicable restricted-party list. Anywear may decline service where required by sanctions or export control law.

3.1 The legal basis for each use above is one of: performing our contract with you (operating the marketplace, fees, payouts, confirmations), a legitimate interest we've weighed against your rights (fraud prevention, service improvement, aggregated reporting), your consent (marketing, where applicable — see §8), or a legal obligation (tax reporting). This mirrors GDPR-style legal-basis categories as a baseline even outside the EU/UK, consistent with §1's approach.

3.2 Fraud and risk decisions may involve automated processing (for example, flagging an unusual payment pattern). If an automated decision significantly affects you — such as an automatic account hold — you can ask for a human to review it; contact us using §12.

6.1 We retain account and profile information for as long as your account is active, and for a reasonable period after closure to handle any outstanding Booking, Buy-Out, dispute, or legal obligation.

6.2 Transaction, commission, and payout records — for both Bookings and Buy-Outs — are generally retained longer than basic account data, since financial records are subject to tax and accounting retention requirements that run several years in most jurisdictions.

6.3 Evidence Locker photos are retained for the length of the relevant Booking's dispute window plus a reasonable buffer, then deleted unless retained longer as part of an active dispute. Buy-Out “not as described” evidence (Terms §6.6) follows the same approach.

2.1 Cancellation eligibility and refund amounts are the same for every Booking and are set out in Part I §9.

2.2 Damage, loss, and non-return liability — including how minor damage, Items beyond repair, and lost, stolen, or unreturned Items are charged, and the Declared Replacement Value cap — are set out in Part I §10. Late-return fees are in Part I §11.

2.3 There is no security deposit. Liability is capped against the Item's Declared Replacement Value and, after a Trust & Safety decision, charged to the Renter's saved card and then any backup card, with set escalation steps for unpaid charges — Part I §7.4 and §10.7–§10.8.

2.4 Which fees are refundable: when a Renter cancels, the refundable share of the rental price follows Part I §9.2, and the Service Fee and the one-time Trust & Safety Fee are not refunded. When a Host cancels after accepting, the Renter receives a full refund including all fees (Part I §9.4). Where a refund is due following a dispute, the amount is set by the Trust & Safety decision under §3.

2.5 A dispute over only some Items in a multi-item Bundle follows Part I §10.6 — handled per affected Item, not as an all-or-nothing claim against the whole Bundle.

3.1 A User initiates a dispute through Get help on the Booking in the app, describing the issue and attaching evidence (time-stamped photos, messages, receipts, or Evidence Locker records as relevant). A Renter reports a problem found on receipt the same day they receive the Item, and a Host reports a problem found on return the same day the Items come back (Part I §10.5). A report freezes payment for the Booking until Trust & Safety decides.

3.2 Anywear's Trust & Safety team acknowledges a submitted dispute within 2 business days.

3.3 Where the two Users cannot reach agreement directly (Part I §10.4), Anywear aims to issue a decision within 10 business days of receiving all evidence reasonably requested from both sides. Complex cases — for example, needing an independent repair estimate — may take longer; we'll tell you if that's happening.

3.4 Once a decision is made, any resulting refund, charge to the Renter's saved or backup card (Part I §10.7), or release of payment to the Host's Wallet (Part I §7.3) is executed through Stripe without further action needed from either User.

3.5 If a Renter disputes a charge directly with their card issuer (a chargeback) instead of using this process, Anywear may place a temporary hold on the account pending the card network's outcome, and the chargeback's result governs instead of an internal decision under §3.3.

4.1 On first use, you'll see a prompt to accept all non-essential tracking, reject it, or manage categories individually. On iOS, this includes Apple's own App Tracking Transparency prompt where relevant, in addition to Anywear's in-app preference center.

4.2 You can change your choice at any time in Settings → Privacy within the app.

4.3 If Anywear operates a marketing website, standard browser cookie controls also apply (Chrome, Safari, Firefox, and Edge each expose these under their own Privacy/Cookies settings).

4.4 On mobile, you can independently limit ad tracking at the OS level: iOS Settings → Privacy → Tracking; Android Settings → Google → Ads → Delete advertising ID.

4.5 Anywear does not currently respond to browser “Do Not Track” signals, as there's no single agreed standard for how sites should honour them. Use the in-app or browser controls in §4.1–§4.4 instead — they have an actual effect, where a DNT signal may not.

2.1 Identity verification requirements — who must verify, and when — are set out in Part I §3.2, with the value-based trust tiers in §3.6, and are not repeated here.

2.2 There is no security deposit. Payment for a Booking is held until the rental is complete (Part I §7.3), and damage and loss liability is capped at the Item's Declared Replacement Value and handled under Part I §10, with the process detail in Part III.

2.3 Evidence and reporting deadlines for damage, loss, and non-return claims — time-stamped photos at handover, receipt, and return, with same-day reporting by the Renter on receipt and by the Host on return — are set out in Part I §5.4, §6.4, §10.5, and §11, with dispute-handling timelines in Part III §3.

2.4 How verification data and other personal information are processed and retained is set out in Part II.

3.1 You're responsible for choosing a strong, unique password and keeping your credentials confidential; enable two-factor authentication where the app offers it.

3.2 Anywear uses automated controls — rate limiting, device and anomaly detection — to resist credential-stuffing and bot activity. An account showing signs of compromise may be suspended pending your confirmation of ownership, independent of any dispute you're party to.

3.3 Repeated failed identity-verification attempts may result in a temporary hold on listing or booking privileges pending manual review. This is a precaution, not a policy-violation finding — it doesn't go through the enforcement process in §7 unless the review actually finds a violation.

3.4 Anywear may ask a User to verify their identity again where an account is flagged — for example, after a change of phone number, or where a card or device appears suspicious (Part I §3.2).

4.1 If you feel physically unsafe during a handover, contact local emergency services first. Report it to Anywear as soon as it's safe to do so — the response-time targets in Part III §3 are for ordinary disputes and don't apply to an active safety emergency, which we treat as a priority regardless of when it's reported.

4.2 Any sexual, threatening, coercive, or otherwise inappropriate conduct during a handover is prohibited under Part I §13 and will result in immediate account action.

4.3 Anywear is not a party to in-person meetings between Users and is not liable for what happens at one, except as required by law — consistent with Part I §4 and §15–§16.

4.4 A lockbox is an optional handover method that a Host may choose to offer and must provide themselves. Anywear does not provide, inspect, or control lockboxes and makes no representation about their location or security; responsibility for a lockbox handover is allocated as set out in Part I §5.8. Renters use a Host's lockbox at their own discretion, and the usual photo and same-day reporting requirements still apply (Part I §10.5).

5.1 Anywear uses layered anti-fraud measures — device and payment-pattern monitoring, duplicate-account detection, and manual review for high-value or high-risk activity — alongside the identity verification in Part I §3.2.

5.2 Prohibited conduct — including multiple accounts to evade a suspension, counterfeit listings, falsified tracking, review manipulation, off-platform transactions to avoid Anywear's fees, and self-referral or other abuse of promotions, referrals, or Packing Tokens — is set out in Part I §6, §8, and §13 and is not restated here.

7.1 If your account is suspended or terminated under Part I §18, you may request an internal review by contacting Anywear within 14 days of the decision.

7.2 The review is handled by someone who wasn't involved in the original decision. We'll tell you the outcome; it's final, without prejudice to any legal right you separately have.
